Lobster Terms Of Use
These terms apply between you and Lobster Global Limited
The terms (“us”, “we”, the “Company” or “Lobster”) refer to Lobster Global Limited
The terms (“App” and “Platform”) refer to the Lobster mobile application
The term (“Your content”) refers to content that you upload, share or provide while using Lobster
1. Introduction
By creating an account on our platform, you agree to be bound by these Terms, our Privacy Policy and our Community Guidelines, each of which are referenced in this Agreement. You must accept these terms in order to use our platform, if at any point you no longer accept them fully you must discontinue use of the platform.
Subject to applicable law, we reserve the right to modify, amend or change the Terms at any time. For certain changes, we may notify you via email. The latest version of this agreement will be available on this page, you are responsible for continually checking this page for any updates to the agreement. If you continue to access or use Lobster after changes to this agreement have been made, your continued use will signify your consent to the changes and you will be legally bound by the updated terms
2. Lobster Restrictions
You agree to:
· Give accurate information when creating or updating your account
· Comply with all applicable laws including but not limited to intellectual property laws and privacy laws
You agree you will not:
· Act in an abusive manner to other users and our employees
· Use our platform for fraudulent purposes
· Advertise services on our Platform without prior written consent
· Share any personal or confidential information that you do not have the full consent necessary
· Participate in the creation, development or use of any tools, software or processes to retrieve user data from Lobster or copy profiles from our Platform
· Test in any way the security of the Lobster platform without prior authorisation
· Use Lobster in any way that would harm other users, the platform or Lobster Global or bring the platform into disrepute
3. Lobster Account Eligibility
You are only authorised to create an account or use Lobster if all of the following are true:
· You are at least 18 years old
· You have not committed, been convicted of, or pled no content to one or multiple crimes of a sexual or violent nature
· You are not required to register as a sex offender in any national or local registry
· You have not been previously banned from the platform
· You can legally enter a binding contract with Lobster Global
If these requirements are not met at any time, you must immediately delete your Lobster account and cease use of Lobster
4. Rights You Grant Us
You grant to Lobster Global a worldwide, perpetual, transferable, sub-licensable, royalty-free license to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, reformat, and incorporate into other works Your Content for the purposes of operating, maintaining, improving our services, and promotional activities. This includes the right to use publicly shared content, such as profile photos, for promotional and marketing purposes. However, Lobster Global will obtain your explicit consent before using your content in any external advertising. By creating an account, you grant Lobster Global this license. The license to your content granted to Lobster Global is non-exclusive, except that Lobster Global’s license shall be exclusive with respect to derivative works created through use of our services.
5. Lobster Content
All content found on Lobster is owned by or licensed to Lobster Global. This includes but is not limited to text, user interfaces, trademarks, logos, images. Lobster Global owns or licenses all content that forms part of our platform. All content including but not limited to user interfaces, trademarks, logo and other images is owned or controlled by Lobster Global and protected by copyright, trademark or applicable law. All rights and ownership of our content is retained by Lobster Global at all times. Users of Lobster are granted a limited license, the details of which can be found in section 9

7. Payment Terms
Lobster may offer subscriptions and one time products for purchase through the App Store and Google Play Store. If you choose to make a purchase, you will then be asked to confirm that purchase. After you have confirmed the purchase, your payment method will be charged for the purchase at the price displayed to you in the App and on the confirmation screen
When you purchase a subscription for our App through the App Store or the Google Play Store, you will continue to be charged until you cancel the subscription. If you have been charged and do not agree with the charge, you may contact Customer Support, alternatively you may contact your bank or payment provider. At any time, you may withdraw your consent to automatic payments through the App Store or the Google Play Store. The deletion of your account on our platform does not terminate your subscription meaning that the automatic payments will continue. If you choose to cancel your subscription, you will continue to enjoy the benefits of the subscription until it expires
Lobster may offer virtual items including but not limited to Ultralikes for sale through the App Store and Google Play Store. These virtual items have no monetary value and are not exchangeable. PURCHASES OF VIRTUAL ITEMS ARE FINAL AND NON-REFUNDABLE. Lobster reserves the right to modify or remove virtual items at any time. By agreeing to these terms, you acknowledge that Lobster is not required to issue a refund for any virtual item purchase
Purchases of subscriptions and virtual items are not refundable apart from in cases where the refund is required by law
8. Community Guidelines
Our community guidelines protect our users and help ensure that all users have a good experience on our Platform. You must agree to our Community Guidelines in order to use our platform. Please consult our Community Guidelines for further information
9. Member License
Subject to these terms, Lobster Global grants you the right to use and enjoy our platform. Lobster Global grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for the uses that Lobster Global intends and as allowed by these terms and applicable laws, provided that you abide by these terms. If you break any of these terms, this license and your permission to use the platform will be immediately terminated
10. Safety Tips
Lobster offers safety tips available in the App to help our users stay safe. We fully encourage our users to review these safety tips and keep them in mind when using our Platform
LOBSTER GLOBAL DOES NOT CARRY OUT BACKGROUND CHECKS ON MEMBERS. YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR SAFETY WHEN USING OUR PLATFORM. LOBSTER GLOBAL IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER OF LOBSTER EITHER ON OR OFF THE PLATFORM
11. Disclaimer
LOBSTER GLOBAL GRANTS ABSOLUTELY NO WARRANTIES OR GURANTEES. LOBSTER GLOBAL WILL NOT BE HELD RESPONSIBLE FOR ANY FLAWS IN THE PLATFORM OR THE ACCURACY OF ANY INFORMATION PRESENTED IN THE APP. LOBSTER DOES NOT HAVE ANY RESPONSIBILITY FOR USER GENERATED CONTENT OR CONTENT PRODUCED BY THIRD PARTIES. USERS SHOULD USE THEIR DISCRETION WHEN ACCESSING INFORMATION ON OUR PLATFORM. LOBSTER GLOBAL DOES NOT GUARANTEE OR ENSURE THAT THE INFORMATION PROVIDED BY THE PLATFORM WILL BE ACCURATE, ERROR FREE OR FREE FROM DEFECTS. LOBSTER IS PROVIDED ON AN ‘AS IS’ AND ‘AS AVAILABLE’ BASIS
12. Liability Limitation
LOBSTER GLOBAL, ITS EMPLOYEES OR ANY ASSOCIATED PARTY WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND. LOBSTER WILL NOT BE LIABLE FOR THE ACTIONS OF UNAFFILIATED THIRD PARTIES. IN NO EVENT SHALL LOBSTER’S TOTAL LIABILITY TO ANY PARTY FOR ALL CLAIMS, WHETHER ARISING DURING OR AFTER THE PERIOD YOU HAVE AN ACCOUNT ON OUR PLATFORM, EXCEED £100. THIS LIABILITY LIMITATION FULLY APPLIES EXCEPT IN CASES WHERE LOCAL LAWS PROHIBIT THE LIMITATION OF CERTAIN DAMAGES, IN SUCH CASES THE LIABILITY LIMITATION WILL APPLY TO THE FULLEST EXTENT OF THE LAW
13. Dispute Resolution
In the event of a legal dispute between you and Lobster Global, the following procedures will apply, unless otherwise prohibited by applicable law
If you are dissatisfied with the platform for any reason, please contact Lobster Global Customer Support first so we can try to resolve your concerns without the need of outside assistance. If you choose to pursue a dispute or claim against Lobster, these terms will apply
“Dispute” is any issue or claim related to this agreement, the platform or our relationship, whether it arose before or after this agreement
Before formally taking legal action or arbitration, you must send a detailed notice to Lobster Global Limited, 272 Bath Street, Glasgow, G2 4JR, Scotland, United Kingdom
Your notice should include your full name, the necessary details to identify your account such as your email address or phone number and a description of the dispute including your claims, the form of resolution you are seeking and any damages you are seeking. You must personally sign this notice for it to be effective
Both parties should try to resolve the dispute informally through negotiation in good faith. Lobster Global may request a phone call to discuss your dispute, and you agree to personally participate with your lawyer if you have legal representation. You may also request a phone to discuss your dispute and Loster Global agrees to have one representative participate
